PLEASE READ THESE TERMS OF SERVICE ("TERMS") CAREFULLY BEFORE USING THE FOSTERBUDDY MOBILE APP ("App"). BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT USE THE APP.

Description of the App:

FosterBuddy is a mobile application designed to connect foster families with organizations and individuals seeking to provide support, resources, and assistance to foster children and families.

Acceptable Use and Eligibility:

a. You must be at least 16 years of age or have reached the age of majority in your jurisdiction to use the App. If you are using the App on behalf of an organization, you represent and warrant that you have the necessary authority to bind that organization to these Terms.

b. You agree to use the App solely for lawful purposes and in compliance with all applicable laws and regulations.

c. You are responsible for providing accurate and up-to-date information during the registration process and for maintaining the security of your account credentials.

User Content:

a. By using the App, you may have the opportunity to submit or post content, including but not limited to text, images, videos, and other materials ("User Content"). You retain all ownership rights to your User Content.

b. You grant Coco's Angels USA (DBA FosterBuddy), a non-profit organization, a worldwide, non-exclusive, royalty-free, fully paid-up, transferable, sublicensable, irrevocable, and perpetual license to use, reproduce, modify, distribute, display, and perform your User Content in connection with the operation and promotion of the App.

c. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the aforementioned license to Coco's Angels USA.

d. Coco's Angels USA reserves the right to remove or refuse to post any User Content that violates these Terms, is deemed inappropriate, or for any other reason without prior notice.

Prohibited Conduct:

When using the App, you agree not to:

a. Violate any applicable laws, regulations, or third-party rights.

b. Use the App for any unlawful, harmful, or malicious purposes.

c. Interfere with or disrupt the App's functionality or servers.

d. Attempt to gain unauthorized access to any portion of the App or other users' accounts.

e. Upload or transmit any viruses, malware, or other harmful code.

f. Impersonate any person or entity, or falsely represent your affiliation with any person or entity.

g. Engage in any form of data scraping, data mining, or data extraction.

Your use of the App is subject to Coco's Angels USA's Privacy Policy, which can be found at www.FosterBuddy.com. By using the App, you consent to the collection, use, and sharing of information as described in the Privacy Policy.

Intellectual Property:

The App, including its design, features, and content, is the intellectual property of Coco's Angels USA and its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works based on the App without the express written consent of Coco's Angels USA.

Termination:

Coco's Angels USA reserves the right to suspend or terminate your access to the App at any time for any reason without prior notice. Upon termination, your license to use the App will be automatically revoked, and you must cease all use of the App.

Disclaimer of Warranties:

THE APP IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. Coco's Angels USA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability:

IN NO EVENT SHALL Coco's Angels USA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Changes to the Terms:

Coco's Angels USA reserves the right to update or modify these Terms at any time without prior notice. Continued use of the App after any such changes will constitute your acceptance of the revised Terms.

Governing Law and Jurisdiction:

These Terms and your use of the App shall be governed by and construed in accordance with the laws of California, USA, without regard to its conflict of laws principles. Any dispute arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Los Angeles, CA USA.
